1. Privacy Statement: LuBu App

LuBu UG (haftungsbeschränkt) i.L. (From here on: “LuBu”) built the LuBu app as a FREE app for its Users. This service is provided by LuBu and is intended for use as is:

This page is used to inform visitors regarding our policies with the collection, use, and disclosure of personal information if anyone decided to use our service. If you choose to use our service, then you agree to the collection and use of information in relation to this policy. The personal information that we collect is used for providing and improving the service. We will not use or share your information with anyone except as described in this Privacy Policy.

INFORMATION COLLECTION AND USE

For a better experience, while using our service, we may require you to provide us with certain personally identifiable information, including, but not limited to First Name, Last Name, Email-Address, Personal Interests, Profile Picture, Profile Settings, User Interaction, App Interaction and more.

The information that we request will be retained by us and used as described in this privacy policy. In regard to this personal data, the provider gains access or insight into the following (categories of) data that directly or indirectly relate to a person:

1. First Name and Last Name
(Required for personal verification, functionality of the software, and user experience)

2. Email-Address
(Required for personal verification, functionality of the software, and user experience)

3. Group Affiliation (organization/company, city or event)
(Required, for personal verification, functionality of the software and user experience)

4. Friends List (number and type of entries)
(Required, functionality of the software and user experience)

5. City
(Required, for location-based functionality of the software. Note: LuBu does not collect the location/GPS of the user)

6. Contact Details (social media links)
(Optional, for personal verification and user experience)

7. Lunch and Coffee Activities and Availability (location, duration, time, updates, frequency and type of appointment)
(Required functionality of the software, "match generation" and user experience, may be required for aggregated network report generation)

8. Profile Settings (personal and business interests, skills & profile text)
(Optional, important for improving the matching algorithm and user experience, may be required for aggregated network report generation)

9. Profile Picture
(Optional, important for recognizing the users among each other, especially for "Unknown-Matches)

In addition, LuBu requires the following authorizations to ensure the functionality and a sufficient user experience:

• Access to the camera
Important to recognize other app users and to be recognized by other app users, especially when meeting people you don't know yet. Granting this authorization is optional, the app can also be used without a profile picture. At no time will LuBu use access to the camera for any other purpose than the user-controlled upload of a profile picture.

• Sending push notifications
Important to notify other app users and to be notified by LuBu, as soon as interactions with other app users occur. Only by granting this authorizations is it possible to use the LuBu App in the sense of the above, as otherwise requests for appointments or networking will remain unrecognized and will considerably impair both one's own user experience and the experience of other users, as in this way requests will remain unanswered and interactions will be unsuccessful.

This data is collected through individual and voluntary information provided by the user during registration and setting up a profile in the App, as well as through interaction with the App. Customer-related data is collected voluntarily as part of the onboarding process as well as by setting up the company's internal In-App group. By obtaining the App via the respective third party provider (iOS App Store & Google Play Services), the user agrees to the following privacy policies.

STORAGE OF PERSONAL DATA

The data is stored and hosted on certified and secured servers within the Federal Republic of Germany (Open Telekom Cloud). The DSGVO-compliant storage of the data is carried out in accordance with the latest laws and regulations on data protection and data security and is therefore constantly updated.

DELETION OF PERSONAL DATA

User data will be deleted immediately as soon as the user wishes to delete his or her profile by selection this option in her or his profile settings. In the company context, a user is also deleted from the company's in-app group if a user can no longer receive the mail sent by the provider as a result of an appointment generated in the app ("Mail Delivery Failed") and this e-mail address is the professional e-mail address. Conclusions about these persons are not possible in the latter procedure for LuBu, or only possible with great and unreasonable effort.

LOG DATA

We want to inform you that whenever you use our Service, in a case of an error in the app we collect data and information (through third party products) on your phone called Log Data. This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other statistics.

COOKIES

Cookies are files with a small amount of data that are commonly used as anonymous unique identifiers. These are sent to your browser from the websites that you visit and are stored on your device's internal memory. This Service does not use these “cookies” explicitly. However, the app may use third party code and libraries that use “cookies” to collect information and improve their services. You have the option to either accept or refuse these cookies and know when a cookie is being sent to your device. If you choose to refuse our cookies, you may not be able to use some portions of this Service.

SERVICE PROVIDERS

We may employ third-party companies and individuals due to the following reasons:

- To facilitate our Service;
- To provide the Service on our behalf;
- To perform Service-related services; or
- To assist us in analyzing how our Service is used

We would like to inform the users of this service that these third parties do not have access to your personal data except for one application (temporarily capturing IP address, see next paragraph: WebRTC). In this case, however, third parties are obliged not to disclose the information or use it for other purposes.

SCOPE AND PURPOSE OF DATA PROCESSING USING THE VIDEO CALL FUNCTION (WebRTC)

The video call function available in LuBu is based on WebRTC, a so-called peer-to-peer procedure for the transmission of audio and video data. In the peer-to-peer procedure, a direct connection is established between the participants after a LuBu match and if both participants enter the video call, if they wish. In order to carry out this video call, it is necessary to determine the public IP address of both participants and transmit it to the respective browser of the other participant for the purpose of establishing the connection.

The IP address is stored for a short time for the purpose of transmission, but is deleted at the latest after the end of the video call / digital match (digital lunch or digital coffee). The transmission and the exchange of IP addresses are encrypted. Access by unauthorized persons is not possible, theoretically the IP address can be retrieved by the other participants via additional programs during the connection. During the video call, all data (audio and video) is exchanged directly and encrypted between both participants of the LuBu video call. Access by third parties is not possible.

Sometimes a network of a participant of the video call is protected by certain firewall configurations, which prevent a direct peer-to-peer connection between the participants. In order to enable the participants to have a video call nevertheless, the operator LuBu offers a TURN server, which mediates the contents between the participants. This connection is established automatically if the direct peer-to-peer connection is not established due to browser settings which cannot be influenced by LuBu. This variant of connections via TURN server is also not visible to LuBu, third parties or employees of the operator WebRTC, as these are encrypted end-to-end, as well.

SECURITY

We value your trust in providing us your Personal Information, thus we are striving to use commercially acceptable means of protecting it. However, please remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and we cannot guarantee its absolute security. All data is hosted in Germany, using the GDPR-compliant Open Telekom Cloud (OTC).

This Service may contain links to other sites, e.g. by following social media links provided by yourself or other users within their user profile (optional). If you click on a third-party link, you will be directed to that site. Note that these external sites are not operated by us. Therefore, we strongly advise you to review the Privacy Policy of these websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

CHILDREN'S PRIVACY

As LuBu is a B2B matching app for employees in companies, our Services do not address anyone under the age of 16. We do not knowingly collect personally identifiable information from children under 16. In the case we discover that a child under 16 has provided us with personal information, we immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we will be able to do necessary actions.

CHANGES TO THIS PRIVACY POLICY

LuBu expressly reserves the right to make reasonable changes to the privacy policy of the app. The customer will be notified of changes by e-mail and by publication on the LuBu website. Any changes are considered as accepted if the customer does not object to them in writing (e.g. e-mail, fax) within six weeks after notification of the changes. LuBu will point out this consequence when announcing the changes. For the timeliness of the objection the date of sending is decisive.

TERMS & CONDITIONS: LuBu App (User Agreement)

By downloading or using the free LuBu app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy, or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages, or make derivative versions. The app itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to LuBu UG (haftungsbeschränkt) i. L. (From here on: “LuBu”).

LuBu is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for, and without notifying you in advance.

LuBu is committed to ensuring that the app is used in a respectful manner. LuBu does not tolerate any forms of racism, nudity, sexism, vulgar behavior, violence and/or other illegal or offensive activities. In case users violate this code of conduct, LuBu reserves the right to ban users from using the app. Criminal acts will be reported, based on the user data we have rightfully collected.

LuBu stores and processes personal data that you have provided us with, in order to provide and enhance our Service (see privacy statement). It’s your responsibility to keep your phone and access to the App secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the LuBu app won’t work properly or at all.

You should be aware that there are certain things that LuBu will not take responsibility for. Certain functions of the App will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but LuBu cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Along the same lines, LuBu cannot always take responsibility for the way you use the App i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, LuBu cannot accept responsibility.

With respect to the responsibility of LuBu for your use of the App, when you’re using the app, it’s important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. LuBu accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

At some point, we may wish to update the app. The app is currently available on Android & iOS – the requirements for both systems (and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. LuBu does not promise that it will always update the app so that it is relevant to you and/or works with the Android & iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

LuBu expressly reserves the right to make reasonable changes to the terms of use of the App. The customer will be notified of changes by e-mail and by publication on the LuBu website. Any changes are considered as accepted if the customer does not object to them in writing (e.g. e-mail, fax) within six weeks after notification of the changes. LuBu will point out this consequence when announcing the changes. For the timeliness of the objection the date of sending is decisive.
